Pennsylvania's E-Cigarette Directory Enforcement Begins October 19

Pennsylvania's Act 57 e-cigarette directory enforcement begins October 19, ending the 120-day transition period. From that date, nicotine vaping products not on the state's ENDS directory may no longer be sold for retail, and the state says they will be treated as contraband subject to seizure, with civil penalties of 500 dollars per unlisted product for retailers.

Pennsylvania's e-cigarette directory regime, established under Act 57 of 2025, entered its enforcement phase on October 19, when the state's 120-day transition period for existing inventory expired, and the directory's restrictions on which products can be sold now apply.

Under the new phase, nicotine-containing e-cigarettes intended for retail sale in the state that are not listed on the Attorney General's electronic nicotine delivery system, or ENDS, directory can no longer be sold for retail, and the state has said the products will be treated as contraband subject to seizure, forfeiture and destruction. The enforcement authority sits with the Attorney General's office, which is administering the directory and the certification process behind it.

The penalties for unlisted products are written into the rule. Retailers, wholesalers and importers face an initial civil penalty of 500 dollars for each unlisted product offered for sale, with higher daily penalties and license sanctions that apply to repeat violations, so the cost of selling off-directory stock rises quickly once a pattern is established.

The obligation on the manufacturing side is the certification and bond regime. The state has set an initial manufacturer certification cost of 2,000 dollars per brand family, plus 200 dollars per brand style, and requires a surety bond of at least 50,000 dollars. The Attorney General's office has said 22 manufacturer certifications remain under review, and the directory is expected to keep growing as those are cleared.

The enforcement date is significant because it is the point at which the state has moved from asking the market to comply to actively enforcing the directory. For retailers in Pennsylvania, October 19 is the line between a product that may be sold as transition inventory and one that the state will treat as contraband.
