Sweden Set to Oppose EU Tobacco Tax Overhaul at Nov. 9 Ministers' Meeting

Sweden is expected to oppose a proposed European Union overhaul of tobacco excise taxes at a Nov. 9 meeting of EU finance ministers, according to an EU official cited by Law360, setting up a potential veto of one of the Commission's flagship health-tax files.
The proposal would substantially increase minimum excise duties on cigarettes and other traditional tobacco products and would, for the first time, introduce EU-wide minimum taxes for nicotine pouches, e-cigarettes and heated tobacco. EU tax legislation requires unanimous approval by member states, meaning Sweden's opposition could block the proposal in its current form.
Sweden has objected particularly to the proposed minimum taxes on tobacco-free nicotine pouches, arguing that member states should retain the ability to set tax rates according to differences in product risk. Stockholm's stance reflects the country's distinctive market, where snus and nicotine pouches are widely used and are credited by Swedish officials with helping drive daily adult smoking down to European-lows.
The European Commission's July 2025 proposal would also introduce new tax categories for e-cigarette liquids and heated tobacco, while excluding traditional tobacco snus from the new regime — an exclusion Stockholm has argued does not go far enough for pouches.
EU ambassadors discussed a revised compromise in October, and finance ministers are scheduled to consider the package on Nov. 9 under the Council's rotating presidency, which is seeking to reach a general approach at the meeting.
Sweden's willingness to use its veto adds to a stretch of turbulence for the file: a wider tobacco-tax agreement foundered in the summer over the pouch minimum, leaving the Tobacco Taxation Directive rewrite in limbo, and Stockholm has so far held firm on its refusal to accept a minimum excise threshold for pouches above €20 per kilogram, according to a separate EU official cited by Law360, despite offers of more flexible phase-in arrangements.
For the vaping and pouch industries, the Nov. 9 session is now the pivotal calendar date: a blocked package returns the file to negotiation with risk-proportionate taxation back on the table, while a general approach — even one Sweden later vetoes at final adoption — would lock in the EU-wide minimum floors that Sweden's market would be forced to absorb.
